About Form I-751

If you received a green card through marriage and your marriage was less than 2 years old when you were granted permanent residence, you received a conditional green card (Form I-551 with a 2-year validity). To become a permanent (unconditional) resident, you must file Form I-751 to remove these conditions. The petition must be filed jointly with your spouse OR alone with an approved waiver (for divorce, abuse, or hardship cases).

Filing Options

Joint Petition (Standard)

Filed together with your spouse. Requires strong evidence that your marriage is bona fide and ongoing.

Waiver of Joint Filing

Filed alone if divorced, if you were a victim of abuse (VAWA waiver), or if extreme hardship would result from deportation. Attorney strongly recommended.

Evidence of Bona Fide Marriage

  • ✓Joint federal and state tax returns for each year of the conditional period
  • ✓Joint bank account statements showing both names and regular activity
  • ✓Joint lease or mortgage in both names
  • ✓Insurance policies (health, auto, life) listing spouse as beneficiary or co-insured
  • ✓Birth certificates of children born of the marriage
  • ✓Utility bills, mail, and correspondence showing same address
  • ✓Photos together across the period of marriage
  • ✓Affidavits from friends and family confirming the couple lives together as husband and wife

FAQs – I-751

Q: What if I missed the 90-day window?

A: File immediately and include an explanation letter. USCIS may excuse late filing for good cause. Consult an attorney as soon as possible if your window has passed.

Q: What if I got divorced?

A: You may file for a waiver of the joint filing requirement based on divorce. An immigration attorney is strongly recommended for waiver cases.

Q: Do we need to be still married when filing?

A: For a joint petition, yes — you must be in a bona fide, ongoing marriage. If your marriage has ended, you need a waiver.
